Westchester County Wrongful Death Lawyer

A Westchester County wrongful death lawyer at Silver Law Group answers the phone 24/7 at 212-470-4544, including nights, weekends, and the morning after a funeral. If a driver, a building owner, a contractor, or a doctor caused your family member’s death, one free call tells you whether New York law gives your family a claim and what has to happen first. We hear from families across the county after fatal crashes on I-287, falls from scaffolding, and medication mistakes on hospital floors. The law gives your family two years from the date of death to sue. A claim against the county or a city can need written notice within 90 days.

The evidence that proves fault is often gone before anyone asks for it. Store-camera video gets recorded over, wrecked cars are sold for scrap, and phone records are harder to get with each month that passes. Call today, and a lawyer can send preservation demands this week.

When a Death in Westchester County Is Wrongful

New York’s wrongful death statute, EPTL 5-4.1, turns on one question. If your family member had survived the injury, could they have sued the person or company that caused it? If the answer is yes, that right passes to the estate’s personal representative after death. If the answer is no, there is no wrongful death case, however tragic the loss.

The test also cuts the other way. Any defense the at-fault party could have raised against your family member, including their own share of fault, can be raised against the estate.

Vehicle crashes are the most familiar source of these claims, but the statute reaches any death caused by someone else’s negligence:

  • Nursing home neglect, such as untreated bedsores that turn septic, unwitnessed falls, or a resident left without enough food or water
  • Unsafe property, from a collapsed stairway or broken balcony railing to a parking garage with dead lighting
  • Construction falls under Labor Law 240(1), which holds owners and general contractors liable when a missing or failed ladder, scaffold, or harness leads to a fall from height
  • Job-site deaths under Labor Law 241(6), which applies when a specific state Industrial Code safety rule was violated
  • Defective products, where the manufacturer and the seller can both answer for a dangerous design or a missing warning

Fatal Crashes on Westchester Highways and Rail Lines

A handful of roads produce a large share of the county’s fatal crash claims. I-287, the Cross Westchester Expressway, runs from the Mario M. Cuomo Bridge at Tarrytown east to I-95 in Rye. I-95 follows the Sound shore through New Rochelle, Mamaroneck, and Port Chester with heavy truck traffic bound for New England. The Hutchinson River Parkway and the Saw Mill River Parkway are older roads with short entrance ramps and narrow shoulders, where one driver’s mistake leaves others little room to react.

Two crashes show how differently these cases can unfold. In July 2009, a driver traveled the wrong way on the Taconic State Parkway in Mount Pleasant and struck an SUV head-on, and eight people died. In a wrong-way crash, the claim runs against the at-fault driver’s estate and the insurance on the vehicle, and toxicology and phone records often decide what happened.

In February 2015, a Metro-North train struck an SUV on the Commerce Street grade crossing in Valhalla, killing six people. Rail cases raise questions a two-car collision does not. Crossing design, warning signals, train speed, and railroad procedures all come into play, and some defendants may be public entities with their own notice rules.

An accidental death lawyer treats the police report as a starting point. The vehicle’s event data recorder, nearby business cameras, and 911 recordings usually tell a fuller story, and each one has to be requested before it disappears.

Medical Malpractice Wrongful Death Claims

A death caused by a hospital or doctor carries two deadlines at once, and the shorter one can end the case before the family knows it has one. CPLR 214-a gives a patient two and a half years to sue from the date of the malpractice, or from the end of continuous treatment for the same condition. The two-year wrongful death clock applies only if that 2.5-year period had not already run out on the day your family member died.

Take a radiologist who misread a scan three years before the patient died. The patient’s own claim had expired, so the family usually has no wrongful death claim either. If the misread happened one year before death, the family has the full two years from the date of death.

A medical malpractice wrongful death attorney checks the dates first and the chart second. Common grounds for a claim include:

  • Misdiagnosis or delayed diagnosis of a heart attack, stroke, sepsis, or cancer
  • Surgical errors, including anesthesia mistakes and internal bleeding no one caught after the operation
  • Medication errors such as the wrong drug, the wrong dose, or a dangerous interaction missed at the pharmacy or the bedside

Records from Westchester Medical Center in Valhalla, or any hospital where your family member was treated, are reviewed by a physician in the relevant specialty before anything is filed.

Who Can File a Wrongful Death Lawsuit in Westchester

Only the personal representative of the estate can bring the lawsuit. A spouse, parent, or adult child cannot file in their own name, even if they lost the most. The representative sues on behalf of every family member the law entitles to share in the recovery.

The representative is one of two people:

  • An executor, when your family member left a will naming one and the Surrogate’s Court admits the will and issues letters testamentary
  • An administrator, appointed by the court through letters of administration when there was no will or the named executor cannot serve

Many families start with limited letters of administration. Limited letters let the administrator file the lawsuit, but they bar settling the claim or collecting money without a further court order. That restriction protects the beneficiaries, because no one can accept an insurer’s offer on the estate’s behalf without a judge reviewing it.

Westchester estates go through the Westchester County Surrogate’s Court at 111 Dr. Martin Luther King Jr. Blvd, 19th Floor, White Plains. The petition identifies the surviving relatives, and each one must receive notice or sign a consent. If relatives disagree about who should serve, the court decides.

We prepare the petition and handle the filing, so you are not filling out court forms in the weeks after a death.

What a Westchester Wrongful Death Case Is Worth

New York pays wrongful death damages for financial losses, not for grief. EPTL 5-4.3 limits recovery to pecuniary losses, meaning the money value of what your family member would have provided had they lived. The case is built from pay stubs, tax returns, and a detailed record of what they did for the household.

The estate can recover:

  • Lost earnings and benefits your family member would have brought home over the rest of their working life
  • Financial support a spouse, children, or parents depended on
  • Household services such as childcare, cooking, home repairs, and driving, which you may now have to pay someone else to do
  • Loss of parental guidance for children, valued on the child’s age and how involved the parent was
  • Funeral and burial expenses
  • Medical bills from the final injury or illness

Under current law, a jury cannot award anything for sorrow, lost companionship, or the shock of the death. That gap hits hardest when the person who died was a child or a retiree without large future earnings.

A separate survival claim belongs to the estate and pays for your family member’s conscious pain and suffering between the injury and death. Proof of awareness matters here. EMS run sheets, hospital notes, and witnesses who saw your loved one speak or respond can carry this claim, especially when someone survived for hours or days.

Fault is the last variable. Under CPLR 1411, any share of fault assigned to your family member reduces the award by that percentage instead of barring the claim. A pedestrian found 20 percent at fault still recovers 80 percent of the damages.

How the Recovery Is Divided Among Family

The money does not follow the will. EPTL 5-4.4 directs the personal representative to distribute wrongful death proceeds to the decedent’s distributees, the close relatives New York’s inheritance rules name, in proportion to the pecuniary loss each one suffered.

A seven-year-old who lost a parent’s support through adulthood may receive a larger share than an adult child who lived independently. The court sets the proportions after a hearing. Distribution happens once liens and expenses are paid, including medical liens, funeral costs, and the legal fee.

The Grieving Families Act: Where New York Law Stands

The Grieving Families Act would let New York juries award damages for the grief and lost companionship that current law excludes. Governor Kathy Hochul has vetoed it four times, most recently on December 5, 2025, when she rejected S4423/A6063.

A new version, S10171, was introduced in 2026 and has sat in the Senate Judiciary Committee since May 4, 2026. It has not come out of committee.

For your family, current law governs any claim filed today. That means pecuniary damages, the separate survival claim, and the two-year deadline described below. No one can say whether a future version would reach deaths that have already happened, and the filing deadline does not pause while lawmakers debate. If a death occurred this year, the case should be built under the rules in force now.

What a Westchester County Wrongful Death Lawyer Costs

Silver Law Group handles every wrongful death case on a contingency fee. The fee is a percentage of the money the family recovers, agreed in writing before work begins and paid out of the settlement or verdict when the case ends. If there is no recovery, you owe no fee. In a wrongful death case, the court that approves the settlement also reviews the attorney’s fee, which gives your family a second check.

Deadlines for Westchester Wrongful Death Claims

EPTL 5-4.1 gives the personal representative two years from the date of death to file the lawsuit. The clock runs from the death itself. It does not start from the accident, from the diagnosis, or from the day the court appoints an administrator.

One extension applies when the same event leads to criminal charges. If a criminal case is brought against the defendant over the death, the estate has at least one year after that criminal case ends to sue, even if the two-year period has already passed.

A DWI prosecution after a fatal crash on the Saw Mill River Parkway is the typical example. The criminal case can outlast two years through plea talks and motions, and the family keeps its civil claim until at least a year after the prosecution ends.

Do not plan your case around the extension. Witnesses move, vehicles get repaired, and the deadlines for government defendants close much sooner.

Claims Against Westchester County, Its Cities, or the State

When the defendant is a government body, the deadlines are shorter and less forgiving. A crash involving one of the county’s Bee-Line buses, a dangerous condition on a city street in Yonkers or Mount Vernon, or a negligent public employee can each lead to a claim against a municipality.

  • GML 50-e requires a Notice of Claim within 90 days. In a death case, those 90 days run from the appointment of the personal representative, which is one reason we file for letters quickly.
  • The lawsuit itself must start within two years of the death under GML 50-i.
  • For state defendants, such as the agency responsible for a state parkway, Court of Claims Act 10(2) requires a claim, or a written notice of intention to file one, within 90 days of the representative’s appointment.

Courts sometimes allow a late Notice of Claim on application, but that relief is discretionary. Treat the 90-day date as fixed.

What Happens After You Call Our Firm

The first weeks of a wrongful death case are paperwork and evidence, and most of it has a deadline attached.

01/

Securing letters of administration

We prepare the Surrogate’s Court petition so the estate has a representative with legal power to sue, which also starts the 90-day notice clock for any claim against the government.

02/

Preserving crash reports and video

Preservation letters go to the drivers, owners, and businesses involved, demanding they keep vehicles, camera footage, maintenance logs, and phone data. We order the police accident report and 911 recordings.

03/

Requesting medical records

We get the full chart from Westchester Medical Center or whichever hospital treated your family member, with ER notes, imaging, and the medical examiner’s report where one exists.

04/

Retaining economists and other experts

An economist turns pay history, benefits, and household work into a documented loss figure. Accident reconstructionists or physicians explain how the death happened.

05/

Filing in Westchester County Supreme Court

The complaint is filed at the courthouse in White Plains, or in the Court of Claims if the state is the defendant. Both sides then exchange documents and take sworn depositions.

06/

Negotiating or going to trial

Insurers make serious offers once they see the evidence. You decide whether to accept, and if an offer does not match the proof, the case goes to a jury.

Questions?

We Have Answers

These are common questions from Westchester families after a wrongful death. A consultation can help you understand how the answers apply to your situation.

Ask Your Question

Can I file a wrongful death claim without criminal charges?

Yes. A wrongful death case is a civil claim, and it only has to show that the defendant’s negligence more likely than not caused the death. Many fatal crashes never lead to charges, and even an acquittal does not end the civil case.

How long does a Westchester wrongful death lawsuit take?

It depends mostly on whether the case settles or goes to trial. A case with clear fault and enough insurance can resolve once the evidence has been exchanged, while one tried in Westchester County Supreme Court can take several years. Either way, the Surrogate’s Court must approve a settlement before any money is distributed.

Can parents sue for the wrongful death of their child?

Parents recover as distributees when the child had no spouse or children, and the estate’s representative, often a parent, brings the suit. Damages cover the child’s lost services, any financial support the parents can show they would have received, and medical and funeral costs. The child’s own pain and suffering is pursued through the separate survival claim.

Can an unmarried partner file a wrongful death claim in New York?

An unmarried partner cannot share in the recovery under current law, because wrongful death proceeds go only to distributees, and that list includes a spouse but not a partner. A partner named as executor in the will can still bring the case for the family. Children the couple had together are distributees and do share.

Are wrongful death settlements taxable in New York?

Generally no. Federal law excludes damages received because of a physical injury or death from income, and New York starts its tax calculation from the federal figure. Punitive damages and interest added to a judgment can be taxable, so ask a tax professional before the money is distributed.

What if the at-fault driver only had minimum insurance?

Look for other coverage. Your family member’s own auto policy may include supplementary uninsured/underinsured motorist coverage, which pays when the at-fault driver’s limits fall short. The vehicle’s owner, the driver’s employer, or a bar that served a visibly drunk driver may also share responsibility.

Do most wrongful death cases settle or go to trial?

Many settle, often after depositions, once both sides can see how the evidence will look to a jury. A file prepared for trial from the first week gives any settlement offer its real test. You make the final decision on every offer.
