A Westchester County Burn & Fire Injury Lawyer at Silver Law Group will review your case for free, at any hour, seven days a week. Call 212-470-4544 before the fire scene is cleared or repaired. The scorched outlet, the melted charger or the disconnected smoke alarm is often the only proof of how the fire started.
Landlords and insurers move fast after a fire. A restoration crew can gut a Yonkers apartment in a day. Once the wiring is gone, so is the cause-and-origin evidence your claim depends on.
Burn cases in Westchester come from apartment fires in Mount Vernon and New Rochelle, lithium-ion battery fires, gas explosions, job sites and vehicle fires on I-287. Each one points to a different defendant and runs on a different clock, and one of those clocks is only 30 days long. A free consultation tells you which rules apply to you, and you pay no fee unless you recover.
If you are still in a hospital bed, the lawyer comes to you.
Do You Have a Burn Injury Case in Westchester?
A burn becomes a legal claim when someone else’s carelessness caused it. New York negligence law asks four questions, and in a burn case each one has a concrete answer.
- The defendant owed you a duty of care. A landlord owes tenants working smoke alarms and safe wiring, and a manufacturer owes buyers a battery that will not catch fire on the charger.
- The defendant breached that duty, for example by ignoring a tenant’s complaint about sparking outlets or skipping a gas-line pressure test.
- The breach caused the fire or explosion that burned you. Fire investigators and cause-and-origin experts draw that line.
- You suffered real harm, such as hospital treatment, grafts, scarring, lost work and pain.
The list of possible defendants is longer than most people expect.
- Landlords and building managers
- Property owners, including stores, restaurants and hotels
- Manufacturers and sellers of batteries, heaters and appliances
- Contractors who did electrical, gas or roofing work
- Drivers whose crash set a vehicle on fire
- Gas utilities that left a leak unrepaired or a line unmaintained
Most fires have more than one cause, so one burn case can involve several defendants and several insurance policies. Name all of them early. A party left out at the start can be hard to add once a deadline passes.
Apartment and House Fires in Yonkers, Mount Vernon, and New Rochelle
Most residential burn claims in the county’s denser cities trace back to something the landlord was supposed to fix. These failures come up again and again in tenant cases:
- smoke alarms that are dead, missing or never installed
- exits and fire escapes blocked by storage, locked gates or broken doors
- overloaded or outdated wiring the landlord knew about and left in place
- unsafe space heaters handed out instead of repairing the building’s heat
On November 23, 2025, a kitchen fire on Cottage Avenue in Mount Vernon displaced about 120 residents. When a fire starts in one unit of a multi-family building, every tenant has a problem. Smoke travels through hallways and stairwells, and people several floors away can be burned or overcome while trying to get out.
If you rent, save every text, email and building-department complaint you sent about heat, wiring or alarms. A written warning that went unanswered is some of the strongest evidence a tenant can have, because it proves the landlord knew.
E-Bike Batteries, Gas Explosions, and Defective Products
Product cases follow a different rule. Under strict product liability, you do not have to prove the manufacturer was careless. You have to prove the product was defective and that the defect burned you. The defect can be in the design, in how your unit was made, or in a missing warning, and the claim can reach the manufacturer and the store that sold it.
The risk is not theoretical here. New Rochelle reported at least five lithium-ion battery fires by 2023, and e-bike and scooter batteries are often charged overnight in bedrooms and hallways.
Gas explosions can be a product case and a negligence case at the same time. A faulty valve or connector points to its manufacturer. A leak that went unrepaired points to the gas utility or the contractor who last worked on the line.
What you keep decides what you can prove.
- the battery, even if it is melted
- the charger and cord
- receipts, order confirmations and the box
- photos of where the device was charging
Do not hand any of it to an adjuster or the seller before you talk to a lawyer. Once a manufacturer’s expert has the battery, you may never see it again.
Workplace Burns: Workers’ Comp and Third-Party Claims
Burns on the job go through workers’ compensation first, and the deadlines are short.
- Give your employer written notice of the injury within 30 days under Workers’ Compensation Law §18.
- File your claim with the Workers’ Compensation Board within two years under WCL §28.
- Have a lawyer check whether anyone other than your employer contributed to the fire.
Comp pays medical bills and part of your lost wages. It pays nothing for pain and suffering, and in most cases you cannot sue your employer.
A third-party lawsuit fills that gap. If a general contractor ran an unsafe welding operation, or a defective torch, generator or heater caused the burn, you can sue that contractor or equipment maker while you collect comp. On construction, demolition and excavation sites, Labor Law §241(6) makes owners and contractors responsible for following specific Industrial Code safety rules. A violation that causes your injury can make them liable even if they never supervised your work.
Car Fires and Crash Burns on Westchester Highways
A collision on the I-287 Cross Westchester Expressway, on I-95, or on the older Saw Mill River Parkway and Hutchinson River Parkway can rupture a fuel line or damage a battery pack in seconds. People trapped by a jammed door or a crushed frame get burned in the time it takes to get them out.
New York’s no-fault coverage pays your first medical bills. To sue the other driver for pain and suffering, though, you have to meet the serious-injury threshold in Insurance Law §5102(d). Burns fit one of its categories more cleanly than most injuries do: significant disfigurement. A graft scar on the face, neck or hands is an injury a jury can see for itself.
Fault now carries more weight in vehicle cases. Under CPLR 1411(b), which covers motor vehicle injury suits filed on or after May 26, 2026, a driver whose share of fault is greater than the defendants’ combined share recovers nothing. At 50 percent or less, your damages are reduced by your share.
That makes the first evidence decisive: dashcam footage, the police accident report and the burned vehicle itself. Do not let the tow yard crush your car before an expert has inspected it.
Burn Degrees, Treatment, and Lifetime Costs
Doctors grade burns by how deep they go, and depth drives both your treatment and the value of your claim.
- First-degree burns damage only the outer layer of skin. They are red and painful and usually heal without scarring.
- Second-degree burns reach the layer below and blister; deeper ones can scar and may need grafting.
- Third-degree burns destroy the full thickness of skin, nerves included, so the area may feel numb. They need skin grafts.
- Fourth-degree burns go through the skin into fat, muscle or bone and can lead to amputation.
The first surgery is often only the start. A skin graft takes healthy skin from another part of your body, which leaves a second wound to heal. As grafts heal, scar tissue can tighten into contractures that pull across elbows, fingers or the neck and limit movement, and release surgeries may follow years later.
Open burns are prone to infection, which can mean more hospital time and more surgery. Many survivors also develop PTSD, with nightmares, flashbacks or panic around heat and flame. That is a real injury and part of your claim.
Westchester Medical Center’s Burn Center in Valhalla was verified by the American Burn Association in 2024 for both adults and children, and it serves as the county’s regional burn center. Some patients are taken to Jacobi Medical Center in the Bronx instead. Records from either hospital, from the first wound measurements to the last rehab note, are the base of your damages case.
What Is a Westchester Burn Injury Claim Worth?
No honest lawyer can put a number on your case at the first meeting, and Silver Law Group will not try. The value comes from your medical records, your work history and your scars, and the claim is built around these losses:
- future surgeries, including graft revisions and contracture releases
- rehab, compression garments and therapy
- lost earnings now, and reduced earning ability later
- permanent scarring and disfigurement
- pain and suffering, including PTSD and the loss of activities you used to do
Where the burn is and how deep it goes both count. A third-degree burn on the hand of a carpenter who needs that hand to work is valued differently from the same burn on someone’s back. Age matters too, because a burned child may need repeat surgeries as they grow and will live with the scar for decades.
Your own fault can lower the number. Outside vehicle cases, CPLR 1411(a) reduces your award in proportion to your share of blame, but you can still recover something even if you were mostly at fault. If a jury finds you 20 percent responsible for a fire that mostly started with a landlord’s bad wiring, you keep 80 percent of the award.
Insurers know this rule well. Expect the adjuster to look for anything that shifts part of the fault onto you, like a space heater placed too close to a curtain or a charger left plugged in overnight.
What Happens After You Hire a Fire Injury Lawyer
The first weeks after you hire a fire injury lawyer are spent locking down evidence before it disappears.
- Send preservation letters to the landlord, the manufacturer and every insurer, so nobody destroys the scene, the device or the surveillance video.
- Get the fire marshal or fire department report, which records where the fire started and what investigators found.
- Pull building-violation records from the city, town or village building department to show the owner had been warned about the hazard.
- Hire an independent cause-and-origin expert to examine the scene and physical evidence, rather than relying on the insurer’s investigator.
- Photograph your healing at regular, dated intervals, so a jury sees what the wounds looked like long before trial.
- File the lawsuit and move into discovery.
Burn lawsuits from across the county are filed in Westchester County Supreme Court at the Daronco Courthouse, 111 Dr. Martin Luther King Jr. Blvd, White Plains. Despite the name, New York’s Supreme Court is the trial-level court for injury cases.
Your job during all of this is treatment. Every adjuster call goes to your lawyer, so you never give a recorded statement about the fire.
How Much a Burn Injury Attorney Costs
You pay nothing upfront to hire a burn injury attorney at Silver Law Group. The firm works on a contingency fee, which means the fee is a percentage of the settlement or verdict and comes out of the money recovered for you. If there is no recovery, you owe no fee.
This arrangement ties the firm’s pay to your result. A lawyer who is paid only from a recovery has every reason to find every defendant, bring in the experts a burn case needs, and push for the full cost of your future surgeries. The percentage is set out in writing before any work starts.
Deadlines for Westchester Burn and Fire Claims
Every burn claim in Westchester has a filing deadline. The shortest ones apply when a government body is involved.
- CPLR 214 gives you three years from the date of injury to sue a private party for negligence.
- EPTL 5-4.1 gives a family two years from the date of death to bring a wrongful death claim.
- A Notice of Claim must be served within 90 days under General Municipal Law §50-e if Westchester County, a city such as Yonkers or White Plains, a town, a village or a fire district is responsible.
- The lawsuit against those public bodies must be filed within one year and 90 days under GML §50-i.
Public defendants show up in fire cases more often than people expect. A village crew may have damaged a gas line, or a fire district truck may have been involved in the crash. Miss the 90-day notice and a strong case against a town or village can be thrown out before it starts.
Work burns also carry the 30-day notice and two-year filing deadlines covered above.
